! Please note that the following terms and conditions apply to the booking of tickets (including advance booking) to the 2010 FORMULA 1 CHINESE GRAND PRIX (the “Event”).

　　

　　1.　　 Ticket Booking Channel

　　　

　　1.1.　　 Private booking channels: Event website (www.racing-china.com), Shanghai Juss Event Management Co., Ltd. (“Juss Event” hereafter) booking office and Juss Event authorized ticket distributors;

　　　

　　1.2.　　 Corporation booking channel: Juss Event booking office, Juss Event authorized ticket distributors.

　　2.　　 Payment

　　　

　　2.1.　　 The payment generated will include the ticket price and the ticket booking fee and ticket delivery fee according to the booking channel used. The above-mentioned fees are separate and should be paid by the ticket booker. The detailed information can be found in “2010 FORMULA 1 CHINESE GRAND PRIX Ticket Information” (“ticket information” hereafter). Except the ticket price, which will be charged by Juss Event, other fee will be charged by Juss Event on behalf of the service provider, or ticket booker can pay the service provider directly.

　　　

　　2.2.　　 The ticket prices listed in ticket information will be in RMB and in USD. The USD prices are for overseas bookers’ reference, and the final USD price will be according to the RMB price and the current RMB to USD exchange rate; domestic bookers can only use RMB to make the transaction. The ticket courier fee will be charged in the same way.

　　　

　　2.3.　　 The ticket bookers should make full payment of the tickets value and other cost generated. The payment can be through cash, credit cards and bank cards, bank check, cashiers’ check, bill of exchange, credit warrant, wire transfer etc. The detailed payment will vary from the bookers’ identity, will and the booking channel used, please discuss with us.

　　　

　　3.　　 Ticket Booking and Issuing

　　　

　　3.1.　　 When booking tickets, bookers should finish the “2010 FORMULA1 CHINESE GRAND PRIX Ticket Order Form” properly. Bookers should fill in true and correct information. Juss Event will issue the confirmation letter or ticket when confirms that bookers finish the ticket booking procedure properly.

　　　

　　3.2.　　 Ticket bookers can choose grandstands but cannot choose seats.

　　　

　　3.3.　　 One ticket will only be valid for one spectator. Only baby in arms could enter the circuit free.

　　　

　　3.4.　　 All the tickets will be available when you are booking. For online reservation from official website, tickets will be delivered to the address you offered within 10 working days after the payment is made. If you have not received the order over 10 working days after you made the payment or have questions about the order you receives, please contact the staffs of Juss Event within 20 days after the order made. 　　3.5.　　 Juss Event will deal with the advance booking, ticket booking, ticket delivery, ticket pick-up and ticket check etc according to the information filled or provided by bookers. Thus any lost caused by incorrect, untrue, or invalid information will be on bookers.

　　　

　　4.　　 Ticket Returning, Ticket Changing and Ticket Replacement

　　　

　　4.1.　　 After the successful ticket booking, which means the payment is received properly; Juss Event won’t accept any request to return tickets, under any circumstance, except if the Event is officially and completely cancelled according to the pre announcement. The circumstances include but are not limited to the certain people, corporation or celebrated people’s possible absence, no matter if they are expected to attend the Event or appeared in the advertisement; bad weather; change of the event regulation; or situation beyond Juss Event’s reasonable control. Any request includes but is not limited to written or oral ticket returning request. In the even that the Event is officially and completely cancelled in accordance with the announcement referred to above, Juss Event will only be responsible for returning the ticket payment, and not any other cost or lost generated. After the commencement of the Event, if the Event is interrupted or stopped ahead of the schedule because of any reason, Juss Event will not accept any request for the return of the cost of any ticket. 　　4.2.　　 Except the Juss Event’s fault happens, Juss Event is not responsible to change the ticket confirmation letter or ticket for ticket bookers.

　　　

　　4.3.　　 Under no circumstances will Juss Event be responsible for replacing tickets in circumstances that include but are not limited to tickets being lost, stolen or otherwise disappearing.

　　　

　　5.　　 Business Purpose Restrictions

　　　

　　Tickets to the Event are strictly non transferable and not for resale.　 No ticket for the Event shall be sold or offered for sale for any form of fee or reward without the prior written consent of Juss Event first being obtained and without complying with these Conditions of Sale for the Event in all respects.　 No ticket for the Event shall used by any person for advertising, promotional or commercial purposes including without limitation, prizes, competitions, contests or sweepstakes without the prior written consent of Shanghai International Circuit and FOA first being obtained.

　　　

　　6.　　 Circuit Sign, Map

　　　

　　The signs and map in public place provided by Juss Event are only for reference, and should not be considered as a part of Juss Event’s undertaking. The directions or descriptions of the circuit layout, grandstands layout and other facilities can be incomplete, the display proportion can be inaccurate, the layout can be changed without previous notice, the natural obstacles and other obstacles can affect spectators’ sight of certain area, ticket buyers should understand and accept that the map can’t be 100 percent reliable.

　　　

　　7.　　 Event Notice

　　　

　　7.1.　　 Ticket holders should understand that the Event (including support race and other events) is dangerous, and there is a possibility of accidents, injury and death of people and lost of property.

　　　

　　7.2.　　 Ticket holders should fully understand that entering into circuit to watch the Event will generate certain danger, and should obey Juss Event or/and F1 institute’s announcement, warning and regulations. Spectators will be responsible for the risk and result caused by their improper deeds.

　　　

　　7.3.　　 Ticket holders should understand that the event will be held on the date approved by FIA and according to its regulations. Juss Event reserves the right to add, cancel or replace any drivers, performers or activities related to event, performance, seat arrangement, other convenience and spectator volume according to the requirement of FIA or/and F1 event institutions, and the right to decide and announce the additional terms for spectators.

　　　

　　8.　　 Change of The Service

　　　

　　Juss Event reserves the right to cancel or change the content of service at any time because of the proper reason. If the up-mentioned change or cancellation happens, except explained in other articles of these terms and conditions, Juss Event will provide other optional services when feasible. If spectator cannot accept the optional services provided, Juss Event will refund according to the cancellation or the change of the service content. Juss Event won’t be responsible for any other cost or lost.

　　　

　　9.　　 Intellectual Property

　　　

　　Ownership of the intellectual property in the Event must be respected. Ticket holders must agree and accept that:

　　9.1　　 Spectators must not make, create, store, record or transmit any kind of sound recording, visual footage or audio-visual footage (“Recording”), or store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or race control data (“Data”) of, at, or in relation to the Event. It is forbidden to take into the Event any equipment that may enable a spectator to do the aforementioned acts. Personal electronic devices (including still image cameras, mobile telephones and other handheld personal communications devices) are permitted within the Event unless otherwise advised, provided that any Recording, Data and any image, including photographic images and any still pictures derived or capable of being derived from a Recording (“Image”) of the Event that is recorded, stored and/or created thereon is used for personal, private and non-commercial purposes only.

　　　

　　9.2　　 As a condition of entry to the Event spectators agree that (a) the use of any such Recording, Data or Image for any form of public advertisement, display, commercial gain or for any other purpose (except for spectator’s private enjoyment) without the prior written consent of Formula One Administration Limited (“FOA”) is strictly forbidden and will constitute a breach of these terms and conditions for which spectator may be liable; and (b) on request by Shanghai International Circuit or FOA, spectator shall assign to FOA in writing the copyright and all other intellectual property in any Image or Recording that spectator creates, makes, stores or records of, at or in relation to the Event.

　　　

　　10.　　 Usage of Personal Information

　　　

　　10.1.　　 Ticket holders acknowledge that unless otherwise agreed with Shanghai International Circuit, spectators agree that event organizations (FIA, Formula One Administration Limited and Formula One Management Limited, Shanghai International Circuit and third parties authorized by Shanghai International Circuit) may make or record film or other forms of moving picture, still picture or any of them of the Event (including, without limitation, of spectators). Spectators must permit the event organizations to use such photographs, film, tape, or other images or likenesses in any media (including publication within and outside People’s Republic of China) for the purpose of event broadcasting, promotion and publicity free of any identification or compensation or infringement.

　　　

　　10.2.　　 Juss Event may collect ticket buyers’ or spectators’ personal information (including but not limited to name, address, telephone number, picture etc). It is necessary for Juss Event in arranging and coordinating grandstand seats, and carrying out surveys and promotion and marketing proposes related to event. Unless ticket buyers or spectators agree to let Juss Event release their information or by government’s or judiciary’s compelling force; Juss Event will keep spectators’ personal information confidential when using it.

　　　

　　11.　　 Risk Alert

　　　

　　11.1.　　 Juss Event shall not take legal liability for any audience being unable to attend the event, or having to delay, pay extra expenses, etc. due to any force majeure or any incident that is out of its control. Neither shall it be legally responsible for any personal injury or damages, etc. suffered from the failure to follow “Guide to Getting into the Racing Premises of the 2010 FORMULA 1 CHINESE GRAND PRIX” or the misbehavior of spectator himself or herself.

　　　

　　11.2.　　 Juss Event shall not take the legal responsibility to guarantee the valid of any ticket booking confirmation letter or ticket that is illegally resold.

　　　

　　11.3.　　 Any ticket obtained from the channels other than the Ticket Booking Channel defined in the 1st condition of THIS conditions may be counterfeit or ticket lost or stolen from others. Juss Event therefore shall not take the legal responsibility to guarantee the valid of these tickets.

　　　

　　12.　　 Obey the Conditions of Entry

　　　

　　12.1.　　 Ticket buyer must read THE 2010 FORMULA 1 CHINESE GRAND PRIX Conditions of Entry (Conditions of Entry for abbreviation) in detail, and obey all the regulation of the Conditions of Entry. The moment when the ticket buyer applies to purchase the ticket through the Ticket Booking Channel is regarded as acknowledgement and acceptance of this Conditions and Conditions of Entry.

　　　

　　12.2.　　 Juss Event withholds the rights to refuse the entrance of any spectator who violates THIS conditions and/or Conditions of Entry as well as the rights to ask him or her to leave the circuit, without refunding any expense or providing any compensation.

　　　

　　13.　　 Applicable Law

　　　

　　Nothing in this Conditions of Entry excludes or derogates from terms implied by law of People’s Republic of China.

　　　

　　14.　　 Explanation and Information Service

　　　

　　If there is any addition or revision to THIS conditions, Juss Event will inform the public through its website or any other public media; detailed explanation of THIS conditions is available at any time on Juss Event ticket booking hotlines or www.racing-china.com.
