Any Spectator holding ticket, credential or other document (referred to as “ticket”) allowing entry to and presence at the 2010 FORMULA 1 CHINESE GRAND PRIX (the “Event”) is subject to the following conditions.
1. Spectators are reminded that motor racing, certain activities associated therewith (including all support events and other racing activities) are dangerous and accidents can happen. Spectators are warned that there is a possibility of an accident causing injury, death or property damage or loss. Spectators should be and have been fully aware of the danger by attendance at the Event. Spectators must abide by and follow all public announcements, directions, warnings or regulations given by Shanghai International Circuit, Formula One Management, Formula One Administration (“FOA”) or any of its/their affiliates in relation to the entry to and attendance at the Event. Spectators bear the risk and responsibility caused by their own inappropriate behaviors.
2. Tickets to the Event are strictly non transferable and not for resale. No ticket for the Event shall be sold or offered for sale for any form of fee or reward without the prior written consent of Shanghai International Circuit first being obtained and without complying with these Conditions of Entry and the Conditions of Sale for the Event in all respects. No ticket for the Event shall used by any person for advertising, promotional or commercial purposes including without limitation, prizes, competitions, contests or sweepstakes without the prior written consent of Shanghai International Circuit and FOA first being obtained. Shanghai International Circuit or any authorized person (referred to as “working staff”) is entitled to refuse entry to or remove from the Event (without refund or compensation) any Spectator (a) in violation of these Conditions of Entry and / or the Conditions of Sale for the Event or (b) who is in possession of a ticket which has been sold or used other than in compliance with these Conditions of Entry and/or the Conditions of Sale for the Event. The provisions of this paragraph 2 are fundamental.
3. Tickets are non-transferable on the day or during the day of presentation. Upon exit, the Spectator wishing to regain entry on the same day will be required by working staff to show his/her ticket to be scanned by the ticket validation machine so that the ticketing system has a record of the Spectator’s temporary departure. To regain entry on the same day, the Spectator will be asked by the working staff to show the ticket to be scanned by the ticket validation machine once again to make a record in the ticketing system that the Spectator with the original ticket has regained entry to the event. Spectator bears the responsibility of refusal of re-entry due to his or her failure to comply with this clause.
4. Every ticket corresponds to certain grandstand and / or seat. Thus every Spectator must gain entry to the Event and be seated at the Event as instructed by the ticket. Spectator shall not enter areas that are forbidden or restricted from spectators without proper permission
5. All tickets must be purchased directly from Shanghai International Circuit or through an official ticket agency authorized by Shanghai International Circuit. Any queries in relation to ticket agencies should be referred directly to Shanghai International Circuit. Any attempt to present any other ticket may lead to refusal of admission to the Event and possible prosecution. Unauthorized vendors will be prosecuted.
6. No person may use the name of the Event or part thereof (nor any abbreviation or foreign language version thereof) nor any logo or graphic device of or relating to the Event for any purpose whatsoever without the prior written consent of FOA first being obtained exercisable in FOA’s discretion. This is a fundamental term.
7. Spectators shall not, without the prior written consent of Shanghai International Circuit, bring any of the following items into the Event: (a) any alcoholic beverage;(b) any glass bottle or container or other glass object (excluding sunglasses, binoculars and prescription glasses);(c) any beverage container (including plastic bottles or cans) with the manufacturers seal broken;(d) any drink cooler or ice box; (e) any structure or item that may be used to erect a structure, or which is capable of supporting the weight of a person including, without limitation, any chairs, lounges, benches or stools (other than a folding fabric chair or folding fabric stool for a non-seating ticket holder);(f) prohibited weapons or controlled weapons or articles capable of being used as weapons or anything which may be used in a way which adversely affects the safety of Spectators or participants in any race or other activity, damages property, or interferes with the comfort of Spectators or with their enjoyment of the Event;(g) any object that could be used to distract, hinder or interfere with the driver of any vehicle or craft taking part in the Event, or disrupt, interrupt, or behave in a manner that may disrupt or interrupt, any race, event or activity, whether intentionally or otherwise including (without limitation) a laser pointer;(h) any animal;(i) any flag larger than 1 meter x 1 meter or with handles longer than 1 meter or any banner;(j) any whistle, loud hailer, public address system, electronic or other broadcast device or any other device which may interfere with electronic or radio communications or broadcasting signals or equipment used by organizations or other persons authorized by such organizations in connection with the Event;(k) any vehicle or transportation device including, without limitation, any motorcar, motorcycle, bicycle, scooter, skateboard, roller skates or roller blades;(l) any firework, flare or distress signal.(m) any item that the Spectator intends (or such quantities of the item from which authorized person can reasonably infer that the Spectator intends) to distribute, hawk, sell, offer or expose for sale;(n) any object, device or substance that may be used to deface or damage any part of the area used for the Event including (without limitation) any spray paint; (o) any audio recorder, camera tripod, monopod or lens with a total focal strength of greater than 200mm, video equipment capable of producing television broadcast quality footage or any other such equipment Shanghai International Circuit deems unacceptable for the purposes of Clause 14 below.
8. Spectators shall not:(a) pick or damage any flower, tree, shrub or other plant;(b) climb or attempt to climb or remain on any tree, fencing structure, wall or forbidden( restricted) building;(c) post, stick or place or attempt to post, stick or place any poster, placard, bill, banner, print, paper or any advertising material on any building, structure, fence, tree or cordon without the prior written consent of Shanghai International Circuit;(d) distribute any printed or visual material or distribute, display or promote any advertising or promotional material, samples of goods or services or any other material or thing, without the prior written consent of Shanghai International Circuit;(e) distribute, hawk, sell, offer or expose for sale any goods or services to collect money or benefit from Spectators, without the prior written consent of Shanghai International Circuit;(f) misuse, damage, remove from Shanghai International Circuit any building and the facility inside it, or deface any part of it (including but not limited to seat, chair, table, structure, vehicle, craft, truck, pipe, tap, tap fitting, conduit, electrical equipment, wiring, etc.);(g) block any thoroughfare including, without limitation, any stairs, steps, aisle, gangway, overpass, underpass, pontoon, bridge, passage, entry or exit;(h) deposit litter, except in a receptacle provided for that purpose;(i) throw or attempt to throw any stone, bottle or other projectile;(j) disrupt, interrupt or behave in any manner that may disrupt or interrupt any race, event or activity, distract, hinder or interfere with a driver of any vehicle or craft or interfere with the comfort of other Spectators or their enjoyment of the Event;(k) use indecent or obscene language or threatening or insulting words or otherwise behave in a threatening, abusive, riotous, indecent or insulting manner;(l) urinate or defecate otherwise than in a building or structure specifically provided for that purpose;(m) interfere with, obstruct or hinder an Authorized Person in the exercise of his or her powers, functions or duties;(n) operate or use a loud hailer, public address system or other broadcast device;(o) conduct public surveys or opinion polls, solicit money, donations or subscriptions from members of the public, without the written consent of Shanghai International Circuit;(p) conduct entertainment without a license from Shanghai International Circuit;(q) smoke in a designated no smoking area; (r) use photographic, video or audio recording equipment in areas where such use is prohibited or as otherwise directed by Shanghai International Circuit.
9. Any Spectator who does not comply with the above provisions (including supplementary provisions stipulated by Shanghai International Circuit from time to time at its discretion) should bear the risks and responsibilities caused by his or her own behavior and may be removed from the Event. Any Spectator who has been removed from the Event is prohibited from re-entering the Event for a period of 24 hours.
10. Shanghai International Circuit or its working staff, may at any time, in consideration of public security or the regulation of this Conditions, require a Spectator’s consent to inspect anything the Spectator brings with him/her inside the circuit.
11. Any consent or any authorization given by Shanghai International Circuit may be revoked by Shanghai International Circuit. If such consent or authorization is withdrawn, the offending person shall immediately leave the Event through the nearest exit.
12. Spectators shall take care of the items they bring with them to the circuit.
13. Children must be taken and accompanied by adults to gain entry to the event. Spectators who bring children to the Event shall give full attention to and be responsible for the behavior of their children.
14. Spectators must not make, create, store, record or transmit any kind of sound recording, visual footage or audio-visual footage (“Recording”), or store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or race control data (“Data”) of, at, or in relation to the Event. It is forbidden to take into the Event any equipment that may enable a Spectator to do the aforementioned acts. Personal electronic devices (including still image cameras, mobile telephones and other handheld personal communications devices) are permitted within the Event unless otherwise advised, provided that any Recording, Data and any image, including photographic images and any still pictures derived or capable of being derived from a Recording (“Image”) of the Event that is recorded, stored and/or created thereon is used for personal, private and non-commercial purposes only.
15. As a condition of entry to the Event Spectators agree that (a) the use of any such Recording, Data or Image for any form of public advertisement, display, commercial gain or for any other purpose (except for Spectator’s private enjoyment) without the prior written consent of Formula One Administration Limited (“FOA”) is strictly forbidden and will constitute a breach of these terms and conditions for which Spectator may be liable; and (b) on request by Shanghai International Circuit or FOA, Spectator shall assign to FOA in writing the copyright and all other intellectual property in any Image or Recording that Spectator creates, makes, stores or records of, at or in relation to the Event.
16. Unless otherwise agreed with Shanghai International Circuit, Spectator acknowledges that event organizations (FIA, Formula One Administration Limited and Formula One Management Limited, Shanghai International Circuit and third parties authorized by Shanghai International Circuit) may make or record film or other forms of moving picture, still picture or any of them of the Event (including, without limitation, of Spectators). Spectator hereby grants the event organizations to use such photographs, film, tape, or other images or likenesses in any media (including publication within and outside People’s Republic of China) for the purpose of event broadcasting, promotion and publicity free of any identification or compensation or infringement.
17. Shanghai International Circuit collects personal information about Spectators (including, without limitation, the name, address, phone number, photos of Spectator) which is necessary for it to operate the Event including coordination of the seating at the Event and conducting research, marketing and promotional activities in relation to the Event. Shanghai International Circuit will use the Spectators’ personal information for the above mentioned purpose in a confidential way unless the Spectators agree to the disclosure of their personal information by Shanghai International Circuit or such disclosure is mandated by the government or judicial department.
18. Nothing in this Conditions of Entry excludes or derogates from terms implied by law of People’s Republic of China.
19. Spectators could consult and obtain detailed content of this Conditions of Entry by dialing ticket hotline 962123 or logging on the official website www.racing-china.com.
20. Spectators will be deemed as having read this Conditions, agreeing to and accepting the full content of this Conditions.
21. Shanghai International Circuit reserves the ultimate right to supplement, amend and interpret this Conditions.
